Other Types of Family Law


Family law does not exclusively focus on marriage and divorce as there are a number of diverse fields that fall under the category of family law.  Some of the more common sections include:

Dependency Law

Dependency law focuses on the ability of the state to take charge of children of parents, for whatever reason, cannot take proper care of them because they lack the resources or capacity to be responsible caregivers.

Restraining Orders

Restraining orders are tools of the court that attempt to prevent unwanted contact between family members or former family members such as spousal abuse and stalking. These court orders can stipulate the level of contact, the amount of space that must be respected, and what constitutes harassment.

Visitation

Visitation rights mainly comprise contact issues between non-custodial parents and their children. These rights are either a result of an agreement between the parents or a settlement handed down by the court.

Guardianships

These acts allow the court to place the security and welfare of children in the hands of people or agencies other than biological parents.

Conservatorships (Elder Law)

Conservatorships are used to when an adult can no longer be held accountable for their wellbeing. Conservatorships can establish power of attorney over legal and/or medical decisions for adults who are incapacitated due to age, injury, or disease.

Emancipation

Emancipation is used for children who seek to have the legal rights as adults. Emancipated minors usually must be able to provide for themselves, live apart from their parents, and be a minimum age, generally 14 or so.

Juvenile Delinquencies/Dependencies

Juvenile delinquency is a crime committed by anyone under the age of 18. The laws that govern these crimes are often vastly different than those for older people, so it takes a special kind of lawyer to adequately defend the rights of children.
